When your tenant moves into the apartment, it is her home. You no longer can enter unless you have permission to do maintenance and repairs or there’s an emergency. Your tenant has the right to possess the unit without harassment or interruption and the right to privacy and peaceful enjoyment of the property.
This means you’re not knocking on the door or phoning all the time, not peeking or staring out a window when they leave or come home, and not rifling through their mail. You also shouldn’t ask personal questions.
Having privacy does not give tenants the right to change locks without asking you first if they can. If they do change locks — with or without permission — they must supply you with a new key.
And if you have to enter the apartment for repairs and maintenance, your tenant cannot legally stop you. You need to inspect the unit if you think there’s a problem; and if your tenant plans to move, you have the right to show the property while she still lives there. Your right to enter applies whether the tenant has a rental agreement or a lease.
Written notice is not necessarily required for you to enter the apartment. If your tenant tells you verbally that you can go inside, that’s good enough. If, however, you occasionally have problems with the tenant, carefully note what day and time permission was granted, and afterward send the tenant an acknowledgment that you were there and what you did.
Did They Really Abandon the Unit?
A landlord or property manager has no other rights to enter unless it’s permitted through a court order or the tenant has been absent for an extended period of time. Just what extended means may be subject to question. So find out how much time your state or community requires you to wait before you can assume that the apartment was abandoned. And follow the rules exactly.
Your tenant could be on an extended vacation or might have had to rush to another state to care for an elderly parent, forgetting to notify you. If the property isn’t abandoned and if you enter too quickly, you might get caught up in a housing or civil rights complaint.
Asking Permission to Enter
In most situations, you should give your tenant 24 to 48 hours and a written notice that you must enter the unit for repairs and maintenance. On the note or form, state the reason why you have to enter, when you’d like to come in, and whether anyone else will be with you.
Remember, if there’s an emergency, you can enter without permission if no one is home. Knock first, call the fire or police department, then use your key.
