Question: Is It Legal to Run a Credit Check on a Prospective Tenant?
Answer: Yes, it is legal for a landlord to run a credit check on a prospective tenant, but the owner or manager must have the tenant’s written permission to do so. The landlord can include a clause at the bottom of the rental application form which states that by signing this form the prospective tenant is consenting to a credit check or the landlord may create a separate form with this same clause which the applicant must sign and consent to.A credit check can be a good way to judge an applicant’s financial situation and their ability to pay rent on time, but you must follow the proper steps to ensure you are doing so legally.
