I have spoken with quite a few potential clients and other providers that work in the same circles. The potential clients want to save money and get screening for cheap. A screening for cheap probably means that you are not getting a real screening, just a quick internet search by some program. Are you explaining FCRA and obtaining release forms? If not, you are probably lucky that no one has ever challenged you in court. It is critical to understand the legalities of these things, what you can and cannot do. Make sure your provider is there for you, providing answers, guidance and support.
It is common that everyone looks for a “bargain” when shopping for services. Who does not want to save a dollar here and there, especially with the economy as it is. The down side of that is sometimes you just get what you pay for. I spoke with one property management company that was upset that I could not offer a screening service for under $10.00 per client. She did not have release forms signed, nor provide the information on adverse actions due to screenings. I urge you to get with your providers and get guidance, support and some quick training.
Some questions that you should be asking include; Does your provider send you updates, newsletters and other information? Do you take the time to read the information? If you do not stay current with the information then you may be putting your business in a very vulnerable situation. Just one lawsuit under the Fair Credit and Reporting Act can cost you hundreds of thousands of dollars.
It is simple to protect yourself and your company. One way it to use a provider that is not worried about scooping as many clients as they can. Make sure your service is focused on quality and having a good product. When you speak with a representative ask yourself if this is a sales person or someone that actually can do the screenings? Again, everyone wants to save money, but is the savings going to amount to a large payout in the future? Does that cut rate service give you cut rate protection? You work hard to keep your properties rented, manageable, making money and clients happy. You and your business should not have to worry about the liability from a poorly handled background check. Make sure that your provider is not just making money from you, but taking care of you.
